This Privacy Policy explains how RAINAWARDS LLC, a Delaware limited liability company ("RainAwards," "we," "us" or "our"), collects, uses, shares and protects personal information when you use rainawards.com and our other websites (the "Sites") and take part in the RainAwards rewards program (the "Program"). It forms part of our Terms of Service. RAINAWARDS LLC is the controller of your personal information.

1. Information we collect

Information you give us

Email address, when you sign up.
Age group, from the age question after you sign up.
Claim information: the verification code you enter, and your acceptance of the Official Rules.
Tax information, only when a reward requires it: your full legal name, Social Security Number or ITIN, and mailing address.
Letters you mail us to verify a claim, which include your name, the email address you used and your claim ID.
Messages you send to support.

Information collected automatically

Your IP address and the country it indicates. We do not collect your precise location.
Your device type, browser and operating system.
The pages and steps you view, the offers you click, and when.
Information stored in cookies and similar technologies (Section 5).
If you allow push notifications: a push subscription (a browser address and keys), not your contact details.

Information from partners

Traffic partners that send you to us pass along their own reference identifiers for your visit (such as a click or sub ID) and the reward amount shown to you.
Advertisers tell us when you complete one of their offers: which offer, the amount they pay us and their transaction reference. They identify you only by a random click identifier we created, not by your email.

We use Social Security Numbers and ITINs only for tax reporting and fraud prevention.

3. How we share information

We do not sell or rent our email list.
Advertisers receive a random click identifier so they can report a completed offer. We do not give them your email address. If you sign up with an advertiser, the advertiser collects your information under its own privacy policy.
Traffic partners that referred you receive back their own reference identifiers and the amounts owed for activity such as a sign-up or completed offer. We do not give them your email address.
Service providers process information for us under contract: website hosting, security and content delivery (for example, Cloudflare), database hosting (MongoDB Atlas), email delivery (Twilio SendGrid), and the browser push services run by Google, Apple, Mozilla and Microsoft. Fonts on the Sites are loaded from Google Fonts, which receives your IP address.
Authorities and legal process: tax authorities (for example, the IRS when a Form 1099 is required), law enforcement or courts when the law requires, and others when needed to prevent fraud or protect rights and safety.
Business transfers: if RainAwards is involved in a merger, acquisition or sale of assets, information may transfer as part of that transaction under this Policy.
With your consent, in any other case.

4. How long we keep information

Sign-up and reward-page information: while you take part, and up to 3 years after your last activity.
Offer completion and reward claim records: 5 years, for fraud prevention and accounting.
Tax information: as long as tax law requires.
Email opt-outs: indefinitely, so that we keep honoring them.
Technical logs of advertiser notifications: about 6 months.
Email verification codes: they expire after 15 minutes.

5. Cookies and similar technologies

We use only cookies needed for the Program to work: one remembers your visit (up to 30 days) and one brings you back to your reward page (up to 90 days). We also store in your browser whether you dismissed the notification prompt. We do not place third-party advertising cookies on our pages. Advertisers' and traffic partners' own websites use their own cookies under their own policies.

6. Security

We encrypt information in transit (TLS). Social Security Numbers and ITINs are encrypted at rest (AES-256) and are never shown in full after you submit them. Administrative access is restricted and protected by strong authentication. No system is perfectly secure, and we cannot guarantee absolute security.

7. Your choices

Email: use the unsubscribe link in any promotional email.
Push notifications: turn them off in your browser settings.
Deletion: you can ask us to delete your information (Section 8). Deleting it ends your participation and forfeits unclaimed points and claims in progress.
Do Not Track / Global Privacy Control: we do not respond to Do Not Track signals. We treat a Global Privacy Control signal as a request to opt out of any sale or sharing of personal information.

8. Your rights

Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information, to object to or restrict certain uses, and to withdraw consent. To make a request, email [email protected] with the subject "Privacy Request." We verify requests by confirming control of the email address on file, and we respond within the time the law requires (generally 30 days, or 45 days under California law, which may be extended once). You may use an authorized agent, and we will not discriminate against you for exercising your rights.

California

In the last 12 months we collected these categories of personal information: identifiers (email address, IP address, click identifiers); personal information described in Cal. Civ. Code § 1798.80 (name, address and Social Security Number, from claimants only); characteristics of protected classifications (age range); commercial information (offers completed and rewards claimed); internet and other network activity; and general geolocation (country). Sensitive personal information (Social Security Number or ITIN) is used only for tax compliance and fraud prevention, which the law allows without offering a right to limit. We do not sell personal information for money and do not knowingly sell or share personal information of consumers under 16. You may still ask us not to sell or share your personal information. Sources, purposes and recipients are described in Sections 1 to 3.

Other U.S. states

Residents of states with consumer privacy laws (such as Virginia, Colorado, Connecticut, Utah and Texas) have similar rights. If we deny your request, you may appeal by replying to our decision; we will respond to appeals within the time the law requires.

European Economic Area, United Kingdom and Switzerland

You have the rights of access, rectification, erasure, restriction, portability and objection, and you may withdraw consent at any time without affecting earlier processing. You may complain to your local data protection authority. The legal bases we rely on are listed in Section 2.

9. International transfers

We are based in the United States, and we store and process information there. Where the law requires, we rely on appropriate safeguards, such as standard contractual clauses, for transfers from other countries.

10. Children

The Program is for adults aged 18 and over. It is not directed to children, and we do not knowingly collect personal information from children under 13 (or under 16 in the European Economic Area and the United Kingdom). If we learn that we have, we delete it. We do not fulfill rewards to anyone under 18. If you believe a child has given us information, contact us.

11. Third-party websites

Partner Offers take you to advertisers' websites, which have their own privacy policies. We are not responsible for their practices.

12. Changes to this Policy

We may update this Policy by posting a new version with a new "Last Updated" date. If a change is material, we will also give notice on the Sites.
